Welcome to Splobe (“Splobe”, "SPLOBE", "we", "us", or "our").

Splobe is a sports and games community and networking platform that helps players, parents and legal guardians, coaches, clubs, training centers, teams, sporting or gaming venues, and other sports organizations discover, connect, communicate, organize, and participate in sports or game related activities.

These Terms and Conditions ("Terms") govern your access to and use of the Splobe website, Progressive Web Application (PWA), mobile applications, social media pages, services, and related features (collectively, the "Service").

By creating an account, creating or managing a profile, accessing, or using the Service, you agree to these Terms.

If you do not agree with these Terms, please do not use the Service.

1. Eligibility and Age Requirements

You must meet the minimum age requirements applicable to your country or location to create and maintain an account individually on Splobe.

Where permitted by applicable law, users between the ages of 13 and 18 may create and manage their own player profile, subject to the parental or legal guardian consent process described in these Terms.

Users below the applicable minimum age may not create or operate an independent account unless permitted by applicable law and supported by an appropriate parent or legal guardian account or consent mechanism.

Splobe may establish different age requirements, consent requirements, verification procedures, or feature restrictions for particular countries or regions in order to comply with applicable laws and protect younger users.

We may request age, identity, parental or guardian information, or other information necessary to determine eligibility for the Service or particular features.

Providing false information about age, identity, parental or guardian status, or authorization is prohibited.

2. Accounts and Account Responsibility

You are responsible for providing accurate information when creating an account or profile.

You must not:

  • Create an account using another person's identity without authorization;
  • Impersonate another person, player, parent, guardian, coach, club, training center, venue, team, or organization;
  • Create false or misleading profiles;
  • Circumvent age or consent requirements;
  • Share your account credentials with unauthorized persons;
  • Create accounts for fraudulent or abusive purposes; or
  • Use another person's account without permission.

You are responsible for activity conducted through your account, subject to applicable law.

If you believe that your account has been accessed or used without authorization, you should notify us promptly.

3. Player Profiles

Splobe allows users to create player profiles to represent themselves or, where permitted, another player.

A player profile may contain information such as:

  • Name or display name;
  • Age or age category;
  • Gender, where voluntarily provided and permitted;
  • Sports, games and playing interests;
  • Playing position or role;
  • Skills and abilities;
  • Achievements;
  • Competition history;
  • Teams, clubs, or training centers;
  • Coaching, venues or training information;
  • Profile photographs;
  • Photos, Videos or other sports-related content; and
  • Other information voluntarily provided by the user.

Users should only provide information that is appropriate and reasonably necessary for the intended purpose of the Service.

Users should avoid publishing unnecessary sensitive information, particularly information that could create a safety or privacy risk for a minor.

4. Self-Created Profiles for Users Between 13 and 18

Where Splobe permits a person between the ages of 13 and 18 to create their own player profile, the user may be required to provide a valid email address belonging to a parent or legal guardian.

Splobe may send a parental or legal guardian consent email to the email address provided.

The minor's account will remain pending or inactive for applicable features until the parent or legal guardian completes the required consent process by following the link or instructions provided in the consent email.

By providing a parent's or legal guardian's email address, the minor represents that:

  • The person identified is their parent or legal guardian;
  • The email address belongs to that parent or legal guardian; and
  • The information provided is accurate to the best of their knowledge.

A parent or legal guardian who approves the account represents that they have the legal authority to provide the required consent.

Splobe may request additional information or verification where required by applicable law or where reasonably necessary to protect the minor or the Service.

If parental or guardian consent is not obtained within the applicable period, Splobe may keep the account inactive, restrict its features, or delete the pending account and associated information, subject to applicable law.

5. Profiles Created for Minors by Parents, Legal Guardians, Coaches, Clubs, Training Centers, Teams, or Other Adults

Where permitted by applicable law, Splobe may allow a parent, legal guardian, coach, club, training center, team, or other authorized adult or organization to create a player profile for a minor.

When a person or organization other than the minor creates a profile for a minor, the person creating the profile may be required to confirm that they have obtained the necessary permission or consent from the player and minor's parent or legal guardian.

By completing the applicable consent declaration or checkbox, the person creating the profile confirms and represents that:

  • They have obtained the necessary permission or consent from player and the minor's parent or legal guardian to create the profile and provide the minor's information to Splobe;
  • They are authorized to create or manage the minor's profile for the stated purpose;
  • The information provided about the minor is accurate to the best of their knowledge; and
  • They understand that Splobe may request evidence of such permission or consent where reasonably necessary or required by applicable law.

The person or organization providing this confirmation is responsible for ensuring that the consent they have obtained is genuine, appropriate, and legally sufficient for the intended use of the minor's information.

Splobe does not independently guarantee the validity of a consent declaration solely because a user or organization has completed a checkbox or confirmation.

Splobe may request documentary evidence, additional verification, direct confirmation from a parent or legal guardian, or other appropriate evidence of consent where we reasonably believe it is necessary, including in response to a complaint, dispute, safety concern, regulatory request, or legal requirement.

Splobe may suspend, deactivate, restrict, or remove a minor's profile if the required consent cannot be established or if we reasonably believe that information was provided falsely or without appropriate authority.

6. Parent and Legal Guardian Responsibility

Where a parent or legal guardian creates, approves, or manages a minor's profile, the parent or legal guardian is responsible for:

  • Receiving player’s concurrence.
  • Providing appropriate consent where required;
  • Reviewing information displayed on the minor's profile;
  • Managing available privacy and profile settings;
  • Ensuring that information provided about the minor is accurate and appropriate;
  • Supervising the minor's use of the Service;
  • Reviewing communications and connections where appropriate;
  • Reporting concerns involving the minor; and
  • Requesting changes, restriction, or deletion of the minor's profile where appropriate.

Splobe does not replace parental, guardian, coaching, educational, or professional supervision.

7. Withdrawal of Parental or Guardian Consent

A parent or legal guardian may request withdrawal of consent for a minor's profile or request changes to or deletion of information relating to the minor, subject to applicable law.

Requests may be submitted through the contact details provided in our Privacy Policy or through applicable controls/contacts available within the Service.

Upon receiving a valid request, Splobe may restrict access to the minor's profile, remove particular information, deactivate the account, or delete the profile, as required or permitted by applicable law within possible time period, as per Splobe team’s work load.

Where a minor's profile was created by a coach, club, training center, team, or other organization, withdrawal of parental or legal guardian consent may result in the profile being restricted or removed even if the organization previously represented that it had obtained consent. Parents or legal guardians should contact Splobe team through contacts provided in the website or app for such cases or withdrawing minor profiles.

8. Consent Records

Where parental or legal guardian consent is required, Splobe may maintain records of the consent process.

Such records may include:

  • Date and time of consent;
  • Method by which consent was provided;
  • Account or profile to which the consent relates;
  • Email address used for the consent process;
  • Consent status;
  • Information relating to the person or organization who created the profile; and
  • Other information reasonably necessary to demonstrate compliance with applicable legal requirements.

Where a coach, club, training center, team, or other organization confirms that it has obtained parental or guardian consent, Splobe may retain the relevant confirmation and associated records.

We may request evidence of consent where necessary to investigate a complaint, respond to a legal or regulatory request, protect a minor, or verify compliance with these Terms.

9. Children's and Minors' Privacy

Splobe recognizes the importance of protecting the privacy and safety of children and minors.

Different countries and jurisdictions may have different requirements relating to the collection, use, disclosure, storage, and processing of children's personal information.

Where required by applicable law, Splobe may require parental or legal guardian consent before collecting or processing certain information relating to a child or minor.

We may provide additional safeguards, restrictions, consent mechanisms, visibility controls, or deletion mechanisms for minor accounts and profiles.

Parents and legal guardians should review our Privacy Policy carefully before creating or approving a minor's profile.

If you believe that information relating to a child has been collected, displayed, or used improperly, please contact us using the contact information provided in our Privacy Policy or website or app.

10. Information About Minors

Users must not provide unnecessary sensitive information about minors.

This may include, depending on the circumstances:

  • Home address;
  • Personal telephone number;
  • School address or schedule;
  • Precise real-time location;
  • Financial information;
  • Government identification numbers;
  • Medical information; or
  • Other information that could create an unnecessary safety or privacy risk.

Users should only provide information about minors that is appropriate and necessary for the intended purpose of the Service.

Splobe may restrict, hide, or remove information where we reasonably believe it creates a safety, privacy, or legal concern.

11. Profile Visibility

Certain profile information may be visible to other users depending on:

  • Account type;
  • User settings;
  • Age;
  • Profile settings;
  • Applicable features;
  • Applicable law; and
  • Safety considerations.

Splobe may modify default visibility settings or restrict particular information for privacy, safety, legal, or operational reasons.

Users should carefully consider what information they choose to make publicly available.

Minor profiles may have additional visibility restrictions or safeguards.

12. Clubs, Training Centers, Coaches, Teams, and Sports Organizations

Splobe may allow clubs, academies, training centers, venues, coaches, teams, and other sports organizations to create organizational profiles and connect with players and families.

An organization or coach's presence on Splobe does not automatically constitute an endorsement, accreditation, certification, background-check guarantee, or recommendation by Splobe unless explicitly stated.

Users and parents or legal guardians are responsible for independently evaluating clubs, venues, coaches, training centers, teams, events, and other sports organizations before participating in activities or providing personal information.

Splobe does not guarantee the qualifications, conduct, safety, availability, reputation, facilities, services, or performance of any coach, club, training center, team, player, venue or organization.

13. Coach and Organization Information

Coaches, clubs, venues, training centers, teams, and organizations are responsible for ensuring that information they publish on Splobe is accurate and not intentionally misleading.

Where applicable, organizations and coaches should provide accurate information about:

  • Qualifications;
  • Certifications;
  • Experience;
  • Club or organization affiliation;
  • Training services;
  • Facilities;
  • Teams;
  • Venues;
  • Sports offered; and
  • Other material information presented to users.

Splobe may request supporting information or verification where appropriate.

Verification by Splobe, if offered, does not guarantee the safety, quality, qualifications, conduct, or future performance of a person or organization.

14. Sports Opportunities

Splobe may help users discover players, teams, coaches, clubs, training centers, competitions, venues, events, trials, or other sports opportunities.

Splobe does not guarantee that a player will:

  • Be selected by a team;
  • Be accepted by a club;
  • Be offered training;
  • Be selected for a competition;
  • Receive coaching;
  • Be recruited;
  • Receive sponsorship; or
  • Receive any particular sporting opportunity.

Any selection, admission, coaching arrangement, training arrangement, employment, sponsorship, trial, competition participation, or other agreement is between the relevant parties.

15. Communication and Connections

The Service may allow users to communicate or connect with other users, including players, parents, coaches, clubs, training centers, teams, venues and sports organizations.

Users must communicate respectfully and must not use this to:

  • Harass, threaten, bully, intimidate, or exploit another person;
  • Groom or sexually exploit minors or anyone;
  • Request inappropriate photographs or personal information from minors;
  • Arrange inappropriate or unsafe contact with minors;
  • Engage in discriminatory or abusive conduct;
  • Send spam or unsolicited commercial communications;
  • Promote illegal activities;
  • Misrepresent identity or qualifications; or
  • Circumvent Splobe' safety or moderation systems.

Splobe may restrict communication or connection features where necessary to protect minors or other users.

16. Child Safety and Prohibited Conduct

Splobe has zero tolerance for child sexual exploitation, grooming, sexual abuse, or other conduct intended to harm or exploit minors.

Users must not use the Service to:

  • Sexually exploit or abuse a minor;
  • Groom a minor;
  • Request or exchange sexual or otherwise inappropriate content involving a minor;
  • Attempt to establish inappropriate private contact with a minor;
  • Encourage a minor to conceal communications or activities from their parent or legal guardian;
  • Arrange unsafe or inappropriate meetings with minors;
  • Threaten, blackmail, manipulate, or exploit a minor; or
  • Facilitate any unlawful activity involving a minor.

Splobe may immediately restrict or terminate accounts where we reasonably believe that such conduct has occurred or may create a risk of harm.

Where appropriate or legally required, Splobe may report suspected child exploitation, abuse, or other unlawful conduct to relevant authorities or child-safety organizations.

17. Safety and Offline Activities

Splobe is a technology platform and cannot guarantee the safety of interactions, training sessions, matches, trials, events, venues or travel, or other activities arranged through the Service.

Users and parents or legal guardians should exercise appropriate caution when meeting people first encountered online.

Parents and legal guardians should use appropriate supervision when minors interact with coaches, clubs, teams, training centers, or other users or while playing at any venues.

Users should independently verify identities, qualifications, safeguarding practices, facilities, venues and other relevant information before participating in offline activities.

Splobe is not responsible for the independent actions or conduct of users or organizations outside the Service, subject to applicable law.

18. User-Generated Content

Users may create, upload, post, or otherwise provide content including:

  • Photographs;
  • Videos;
  • Player biographies;
  • Achievements;
  • Comments;
  • Team information;
  • Club information;
  • Training information; and
  • Other sports-related material ("User Content").

You retain ownership of User Content that you own.

By submitting User Content to Splobe, you grant Splobe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, process, and distribute that content as reasonably necessary to operate, maintain, improve, and provide the Service.

You represent that:

  • You have the necessary rights and permissions to submit the content;
  • The content does not unlawfully infringe another person's rights;
  • You have obtained any consent required for photographs or videos of other people; and
  • Where the content relates to a minor, you have the authority and consent required to submit it.

You may request removal of User Content subject to applicable law and our policies.

19. Photographs and Videos of Minors

Splobe is a sports platform, and photographs or videos of sports activities may naturally include players who are minors. We therefore do not prohibit the sharing of legitimate sports and games related photographs or videos solely because a minor appears in them.

Users, including players, parents or legal guardians, coaches, teammates, clubs, training centers, teams, event organizers, venue owners and other authorized persons, may upload photographs or videos involving minors where they have the necessary rights, permissions, or other lawful basis to do so.

Examples may include:

  • Match or game photographs;
  • Training and practice photographs or videos;
  • Team photographs;
  • Tournament and competition photographs;
  • Sports event photographs;
  • Award and celebration photographs;
  • Club or training-center activities; and
  • Other legitimate sports or games related content.

When uploading content involving a minor, the person uploading the content is responsible for ensuring that they have the necessary permission, authorization, or other lawful basis to upload and share the content, where required by applicable law.

Users must not upload or share photographs or videos of minors that:

  • Are sexual, exploitative, abusive, or inappropriate;
  • Are intended to embarrass, harass, bully, threaten, or harm the minor;
  • Reveal unnecessary sensitive personal information;
  • Reveal a minor's precise location in a way that creates a safety risk;
  • Misrepresent the minor or the circumstances in which the image or video was taken;
  • Are used for inappropriate commercial, promotional, or other purposes without the necessary authorization; or
  • Otherwise violate the minor's privacy, safety, dignity, or legal rights.

Parents or legal guardians may contact Splobe to report concerns about photographs or videos involving their child. Where appropriate, and subject to applicable law and the circumstances of the content, Splobe may restrict visibility, remove the content, or take other appropriate action.

Splobe may remove or restrict photographs or videos involving minors where we reasonably believe that the content creates a safety, privacy, exploitation, abuse, or other legal concern.

Nothing in this section is intended to prevent legitimate sharing of photographs or videos of sporting events, games, practices, teams, or other ordinary sports activities where such sharing is permitted by applicable law and appropriate permissions or other lawful bases exist.

20. Location Information

Certain features may use approximate or precise location information to help users discover nearby clubs, teams, training centers, players, events, or sports activities.

Location features may be subject to additional privacy controls.

Users should not publish a minor's precise home location or other sensitive location information unless there is a legitimate reason and appropriate authorization.

Splobe may limit the display or sharing of precise location information, particularly for minor profiles.

21. Prohibited Activities

You must not use the Service to:

  • Commit fraud or impersonation;
  • Harass or abuse other users;
  • Upload illegal or harmful content;
  • Promote violence or criminal activity;
  • Distribute malware or malicious code;
  • Attempt unauthorized access to accounts or systems;
  • Scrape or collect personal information without authorization;
  • Use automated systems to misuse the Service;
  • Circumvent security or access controls;
  • Create misleading organizational or player profiles;
  • Exploit or target minors;
  • Misrepresent sporting qualifications or achievements;
  • Use the Service for unlawful commercial activity; or
  • Violate applicable laws or regulations.

22. Reporting and Moderation

Splobe may provide mechanisms for users to report profiles, content, messages, organizations, or conduct that they believe violates these Terms or creates a safety concern.

We may investigate reports and may take actions including:

  • Removing content;
  • Restricting visibility;
  • Suspending accounts;
  • Removing or deactivating profiles;
  • Restricting features;
  • Blocking users; or
  • Permanently terminating accounts.

We may take immediate action where we reasonably believe there is a risk of harm, exploitation, fraud, abuse, or violation of law.

We may cooperate with law enforcement, child-safety organizations, regulators, or other appropriate authorities where legally required or reasonably necessary to protect users or comply with applicable law.

23. Accurate Information and Misrepresentation

You agree to provide information that is accurate and not intentionally misleading.

This includes information relating to:

  • Identity;
  • Age;
  • Sports or games participation;
  • Skills;
  • Achievements;
  • Coaching qualifications;
  • Club or team affiliation; and
  • Organizational or venue information.

You must not falsely claim qualifications, achievements, affiliations, certifications, or positions.

Splobe may remove or restrict information that we reasonably believe is false, misleading, fraudulent, or inappropriate.

24. Privacy

Your use of Splobe is also subject to our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information.

Our Privacy Policy should be read together with these Terms.

Where applicable, the Privacy Policy will provide additional information regarding:

  • Personal information;
  • Minor information;
  • Parental or guardian consent;
  • Location access;
  • Cookies and similar technologies;
  • Data retention;
  • Data deletion;
  • International data transfers;
  • User rights; and
  • Contact procedures.

25. Third-Party Services

Splobe may integrate with third-party services, including authentication providers, hosting providers, analytics services, payment providers, mapping services, and other technology providers.

Your use of third-party services may be subject to those providers' own terms and privacy policies.

Splobe is not responsible for the independent actions, availability, security, or policies of third-party services.

26. Intellectual Property

The Splobe name, SPLOBE brand, logo, branding, software, design, functionality, and original content are owned by or licensed to Splobe and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, reverse engineer, or exploit Splobe' intellectual property.

27. Third-Party Links and Services

The Service may contain links to websites, applications, organizations, clubs, training centers, or other third-party services.

Splobe does not control and is not responsible for third-party websites or services.

Users should review the relevant third party's terms and privacy policies before using them.

28. Payments and Transactions

Where Splobe facilitates payments, subscriptions, bookings, registrations, or other transactions, additional terms may apply.

Unless expressly stated otherwise, Splobe is not a party to agreements between users, coaches, clubs, training centers, teams, or other organizations.

Any disputes regarding services purchased from another user or organization should generally be resolved with that party, subject to applicable consumer-protection laws.

29. Account Suspension and Termination

We may suspend, restrict, or terminate an account if we reasonably believe that the user:

  • Violated these Terms;
  • Provided false or misleading information;
  • Engaged in harmful or abusive conduct;
  • Created a safety or security risk;
  • Violated applicable law; or
  • Used the Service in a manner that could harm Splobe or its users.

Where appropriate and legally required, we may provide notice and an opportunity to appeal.

Users may stop using the Service at any time and may request deletion of their account subject to applicable law and our Privacy Policy.

30. Account and Profile Deletion

Users may request deletion of their account or profile subject to applicable law and our Privacy Policy.

Where a minor profile is involved, a parent or legal guardian may request restriction or deletion of the profile or information relating to the minor, subject to applicable law.

Certain information may need to be retained where required by law, necessary to resolve disputes, prevent fraud or abuse, protect the safety of users, or otherwise permitted by applicable law.

31. Disclaimer

The Service is provided on an "as available" and "as is" basis to the maximum extent permitted by applicable law.

Splobe does not guarantee that:

  • The Service will always be available;
  • Information provided by users or venue hosts/owners will always be accurate;
  • Profiles or organizations are genuine or trustworthy;
  • Coaches or organizations possess particular qualifications;
  • Sporting opportunities will be available;
  • Interactions between users will be safe;
  • User-generated content will always be accurate or appropriate; or
  • The Service will be free from errors or interruptions.

Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable law.

32. Limitation of Liability

To the maximum extent permitted by applicable law, Splobe will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from your use of the Service.

Splobe is not responsible for the independent conduct, representations, services, or actions of users, coaches, clubs, training centers, teams, venues, organizations, or other third parties.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

33. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, and reasonable expenses arising from your violation of these Terms, misuse of the Service, or infringement of another person's rights.

This provision does not apply to the extent prohibited by applicable law.

34. Changes to the Service

We may modify, add, or remove features of the Service from time to time.

We may also update these Terms when reasonably necessary.

If changes are material, we will provide notice through the Service or other appropriate means where required by applicable law.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.

35. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, applicable laws, safety requirements, or our business practices.

When changes are material, we will provide appropriate notice where required by applicable law.

The updated Terms will become effective on the date specified in the updated Terms.

36. Governing Law and Disputes

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, the courts located in Chennai, Tamil Nadu, India shall have jurisdiction over disputes arising out of or relating to these Terms or the Service.

For users in countries where mandatory consumer, privacy, children's-rights, or other legal protections apply, nothing in these Terms is intended to remove, restrict, or waive any rights or protections that cannot legally be excluded or waived under applicable law.

Where applicable law provides users with mandatory rights or requires disputes to be resolved in a particular jurisdiction, those rights and requirements will continue to apply.

38. Agreement

By creating an account, creating or managing a profile, accessing, or using Splobe, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

If you are creating, approving, or managing a profile for a minor, you additionally confirm that you have the authority and consent necessary to do so as described in these Terms and applicable law.
