Splobe Terms and Conditions

Welcome to Splobe (“Splobe”, “we”, “us”, or “our”).

Splobe is a sports and games community and networking platform that helps players, parents and legal guardians, coaches, clubs, training centers, teams, venues, event organizers and other sports organizations discover, connect, communicate, organize and participate in sports and game-related activities.

These Terms and Conditions (“Terms”) govern your access to and use of the Splobe website, Progressive Web Application (PWA), mobile applications, social media pages, services and related features (collectively, the “Service”).

By creating an account, creating or managing a profile, accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and Accounts

Splobe accounts may only be created and maintained by individuals who are 18 years of age or older, including adult players, parents, legal guardians, coaches and authorized representatives of organizations.

Persons under 18 may not create standalone accounts or independent login credentials. They may participate through a parent-managed child profile, subject to applicable law and Splobe's requirements.

You must provide accurate information and must not:

• Impersonate another person or organization;
• Create false or misleading profiles;
• Circumvent age or consent requirements;
• Share account credentials with unauthorized persons;
• Use another person's account without permission; or
• Use the Service for fraudulent, abusive or unlawful purposes.

You are responsible for activity conducted through your account. If you believe your account has been accessed without authorization, please notify Splobe promptly.

2. Parent-Managed Profiles for Minors

A profile for a person under 18 (“Child Profile”) may be created and managed by a parent or legal guardian through a registered adult account.

The parent or legal guardian represents that:

• They are the parent or lawful legal guardian or otherwise have the required authority;
• Information provided about the child is accurate;
• They provide any consent required by applicable law;
• They supervise the child's participation and use of the Service; and
• They are responsible for bookings, registrations, communications and activities undertaken on behalf of the child.

Where permitted by applicable law, Splobe may also allow a coach, club, training center, team or other authorized organization to create or manage a minor's profile. Such person or organization must have the necessary permission or consent and may be required to provide evidence of that authority.

Splobe may request additional verification or evidence of consent where reasonably necessary or required by law.

3. Minor Safety and Privacy

Splobe is committed to protecting the safety and privacy of children and minors.

Users must not use the Service to:

• Groom, sexually exploit or abuse a minor;
• Request or exchange inappropriate content involving a minor;
• Attempt inappropriate private contact with a minor;
• Encourage a minor to hide communications or activities from a parent or guardian;
• Arrange unsafe or inappropriate meetings with minors;
• Threaten, blackmail, manipulate or exploit a minor; or
• Facilitate unlawful activity involving a minor.

Splobe may immediately restrict or terminate accounts where we reasonably believe there is a risk of harm, exploitation, abuse or other unlawful conduct and may report suspected unlawful conduct to appropriate authorities where required or appropriate.

Users should not provide unnecessary sensitive information about minors, including home addresses, personal telephone numbers, school schedules, precise real-time locations, financial information, government identification numbers or medical information.

Splobe may restrict, hide or remove information where we reasonably believe it creates a safety, privacy or legal concern.

Parents or legal guardians may request changes to, restriction of, or deletion of a child's profile or information, subject to applicable law and the Privacy Policy.

4. Profiles and Information

Users may create profiles containing information such as name or display name, age or age category, gender where voluntarily provided, sports and games interests, playing position, skills, achievements, competition history, teams, clubs, training information, photographs and other voluntarily provided information.

Users are responsible for ensuring that information they provide is accurate and not intentionally misleading.

Users must not falsely claim qualifications, achievements, certifications, affiliations, positions or other credentials.

Profile visibility may depend on account type, age, settings, features, applicable law and safety considerations. Splobe may modify visibility or restrict information for privacy, safety, legal or operational reasons.

5. Coaches, Clubs, Teams, Venues and Organizations

Splobe may allow coaches, clubs, academies, training centers, teams, venues, event organizers and other sports organizations to create profiles and connect with users.

The presence or listing of any person or organization on Splobe does not automatically constitute an endorsement, accreditation, certification, background-check guarantee or recommendation by Splobe.

Users and parents or legal guardians should independently evaluate coaches, clubs, venues, events, facilities, qualifications and services before participating or providing personal information.

Organizations and coaches are responsible for the accuracy of information they publish, including qualifications, certifications, experience, affiliations, facilities, teams and services.

Any verification provided by Splobe does not guarantee the safety, quality, qualifications, conduct or future performance of a person or organization.

Splobe does not guarantee that a player will be selected, accepted, recruited, sponsored, offered coaching or training, or receive any particular sporting opportunity.

6. Communication and Team Pods

Splobe may provide communication and collaboration features, including private or group spaces called Team Pods.

Users must keep communications respectful and sports-focused and must not use the Service for:

• Abuse, threats, harassment or discrimination;
• Defamation or harmful conduct;
• Unsolicited promotions, advertisements or spam;
• Illegal activity; or
• Conduct that creates a safety or privacy risk.

Minor participation in Team Pods and communications is subject to the applicable parent or guardian controls and supervision provided by Splobe.

Splobe may moderate, restrict or terminate access to communication features when reasonably necessary for safety, policy or legal reasons.

7. Photos, Videos and User Content

Users may upload photographs, videos, biographies, achievements, comments, posts, community updates and other content (“User Content”).

You retain ownership of User Content that you own. By uploading User Content, you represent that you have the necessary rights, permissions or lawful basis to upload and share it.

Content involving minors must be shared only where the uploader has the necessary parental/guardian consent, authorization or other lawful basis where required.

Users must not upload content involving minors that is:

• Sexual, exploitative or abusive;
• Intended to bully, threaten, embarrass or harm;
• Unnecessarily revealing of sensitive personal information;
• Used to expose a minor's precise location in a manner creating a safety risk;
• Misleading or unlawfully used; or
• Otherwise harmful or contrary to the minor's privacy, safety, dignity or legal rights.

Splobe may remove or restrict content that violates these Terms, community standards, applicable law or creates a safety or privacy concern.

8. Location Information

Certain features may use approximate or precise location information to help users discover nearby sports activities, clubs, teams, venues, events or other opportunities.

Location use is subject to the Privacy Policy and applicable settings.

Users must not unnecessarily publish a minor's precise home location or other sensitive location information. Splobe may limit the display or sharing of precise location information, particularly for minor profiles.

9. Prohibited Activities

You must not use the Service to:

• Commit fraud or impersonation;
• Harass, abuse or threaten others;
• Upload illegal or harmful content;
• Promote violence or criminal activity;
• Distribute malware or malicious code;
• Attempt unauthorized access to accounts or systems;
• Scrape or collect personal information without authorization;
• Circumvent security or access controls;
• Create misleading player or organizational profiles;
• Exploit or target minors;
• Misrepresent sporting qualifications or achievements;
• Conduct unlawful commercial activities; or
• Violate applicable laws or regulations.

10. Reporting, Moderation and Enforcement

Splobe may provide tools for reporting profiles, content, messages, organizations or conduct.

Where appropriate, Splobe may:

• Remove content;
• Restrict visibility;
• Restrict features;
• Block users;
• Suspend or deactivate accounts or profiles; or
• Permanently terminate accounts.

Splobe may take immediate action where reasonably necessary to address safety risks, exploitation, fraud, abuse, security concerns or violations of law.

Splobe may cooperate with law enforcement, regulators, child-safety organizations or other appropriate authorities where legally required or reasonably necessary.

11. Payments, Bookings and Third-Party Services

Where Splobe facilitates payments, bookings, registrations, subscriptions or other transactions, additional terms may apply.

Unless expressly stated otherwise, Splobe is not a party to agreements between users, coaches, clubs, training centers, teams, venues, event organizers or other organizations.

Disputes relating to services provided by another person or organization should generally be resolved with that party, subject to applicable law.

Splobe may use third-party services such as authentication providers, hosting providers, payment providers, analytics services, mapping services and other technology providers. Such services may be subject to their own terms and privacy policies.

Splobe is not responsible for the independent actions, availability, security or policies of third-party services.

12. Intellectual Property

The Splobe name, brand, logo, software, design, functionality and original content are owned by or licensed to Splobe and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, reverse engineer or otherwise exploit Splobe's intellectual property.

13. Suspension, Termination and Deletion

Splobe may suspend, restrict or terminate an account where we reasonably believe that a user:

• Violated these Terms;
• Provided false or misleading information;
• Engaged in harmful or abusive conduct;
• Created a safety or security risk;
• Violated applicable law; or
• Used the Service in a manner that could harm Splobe or its users.

Users may stop using the Service at any time and may request deletion of their account or profile, subject to applicable law and the Privacy Policy.

Certain information may be retained where required by law or reasonably necessary to resolve disputes, prevent fraud or abuse, protect users, or comply with legal obligations.

14. Disclaimer and Limitation of Liability

The Service is provided on an “as available” and “as is” basis, to the maximum extent permitted by applicable law.

Splobe does not guarantee that:

• The Service will always be available or error-free;
• Information provided by users or organizations will always be accurate;
• Profiles, organizations or events are genuine or trustworthy;
• Coaches or organizations possess particular qualifications;
• Sporting opportunities will be available;
• Interactions between users will always be safe; or
• User-generated content will always be accurate or appropriate.

Splobe is a technology platform and does not guarantee the safety of offline interactions, training, matches, trials, events, venues, travel or other activities arranged through the Service.

Users and parents or legal guardians should independently verify relevant identities, qualifications, facilities, venues and safeguarding practices and exercise appropriate caution when participating in offline activities.

To the maximum extent permitted by applicable law, Splobe will not be responsible for indirect, incidental, special, consequential or punitive losses arising from use of the Service.

Splobe is not responsible for the independent conduct, representations, services or actions of users, coaches, clubs, teams, venues, event organizers or other third parties.

Nothing in these Terms excludes or limits liability or rights that cannot legally be excluded or limited.

15. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities and reasonable expenses arising from:

• Your violation of these Terms;
• Your misuse of the Service; or
• Your infringement of another person's rights.

This provision applies only to the extent permitted by applicable law.

16. Changes to the Service and These Terms

Splobe may modify, add or remove features from the Service from time to time.

We may also update these Terms to reflect changes to the Service, applicable laws, safety requirements or our business practices.

Where changes are material, Splobe will provide appropriate notice where required by applicable law.

Updated Terms will become effective on the date specified in the updated Terms. Continued use of the Service after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.

17. Governing Law and Disputes

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, the courts located in Chennai, Tamil Nadu, India shall have jurisdiction over disputes arising out of or relating to these Terms or the Service.

Nothing in these Terms is intended to remove, restrict or waive mandatory consumer, privacy, children's-rights or other legal protections that cannot legally be excluded or waived.

19. Agreement
